Irving, TX, June 21, 2019 – The Gibson Law Group won an important procedural victory this week in the Dallas Court of Appeals for its client Joel Kelley Interests (Cause No: 05-19-00559-CV; In re: Joel Kelley Interests, Inc., Realtor,) a Houston-based real estate investment group. The firm substituted in midway through the underlying litigation involving the sale of a local c-store and claims for breach of contract and usury. GLG immediately raised several important defenses omitted by prior counsel, including a consequential motion to dismiss, which, if granted, would end the matter without further litigation.

The trial court refused to rule on this important motion to dismiss, which left the firm no choice but to ask the appellate court to intervene.  In a 3-0 decision, the Court of Appeals ruled in our client’s favor, ordering the trial court to address our motion to dismiss.  Congratulations to Joel Kelley Interests on this important victory on the path to ultimate vindication.
